1. Overview
These Terms of Use (“Terms”) govern your access to and use of the Global Talent Pathway candidate portal and related websites, applications, features, and services (together, the “Platform”). The Platform supports workforce services, including candidate profiles, applications, communications with employers or recruiters, and, where enabled, marketplace functions such as role advertising, search, matching, and targeted advertising.
Please read these Terms carefully. They affect your rights and responsibilities. If you do not agree, do not create an account or use the Platform.
2. Who we are and who you contract with
In these Terms, “GTP”, “we”, “us”, or “our” means Global Talent Pathway and, where relevant, its related bodies corporate and trading entities (the “GTP Group”).
Your contractual relationship for Platform access is with the GTP entity identified on the Platform page footer or account registration flow, unless we expressly state otherwise. Some services may also be subject to additional terms or product-specific agreements. If there is a direct conflict, those additional terms prevail for that specific service.
3. Changes to these Terms
We may update these Terms from time to time. The current version will be available on the Platform.
If we reasonably consider a change to be materially detrimental, we will provide prior notice through the Platform or by other reasonable means, where practicable.
By continuing to use the Platform after an update takes effect, you accept the updated Terms.
4. Eligibility and account registration
To create an account, you must:
be capable of entering into a legally binding contract in your location, and
provide accurate, current, and complete information.
You must keep your account information up to date. If you register or use the Platform on behalf of another person, you represent that you are authorised to do so. Candidates must not create profiles or apply for roles on behalf of another person.
5. Account security and login credentials
You are responsible for maintaining the confidentiality of your login credentials, including passwords and any linked login (Google, Facebook, Apple ID or other supported identity providers).
You must notify us promptly if you believe your account has been compromised or used without authorisation.
We may require you to reset credentials, apply additional security steps, suspend access, or restrict features if we reasonably believe there is a security risk, misuse, or breach of these Terms.
You are responsible for activity conducted through your account, except to the extent it results from our failure to apply reasonable security measures within our control.
6. The Platform and our role
The Platform may act as:
a candidate portal where you create a profile and submit applications,
a workflow system enabling communication and processes between candidates and employers or recruiters, and
where enabled, a marketplace venue allowing employers or recruiters to advertise opportunities and search for candidates.
We do not employ candidates through the Platform and we do not guarantee that any candidate will be selected, interviewed, or hired.
Employers or recruiters are responsible for their own recruitment decisions, role requirements, workplace terms, and compliance obligations.
7. Candidate obligations and integrity requirements
You agree that all information you submit through the Platform, including profile information, resumes, answers to questions, credentials, and communications, must be:
true and accurate,
complete and not misleading, and
kept up to date.
You must not:
impersonate another person,
provide false or misleading identity or credentials,
upload forged or altered documents,
manipulate Platform features to misrepresent eligibility or suitability,
harass or threaten others, or
use the Platform for unlawful purposes.
We may take action if we reasonably believe you have breached these requirements, including restricting your account, removing content, or terminating access.
8. Prohibited use
You must not:
attempt to gain unauthorised access to systems or data,
probe, scan, test, or attempt to bypass security controls,
use bots, scrapers, data mining tools, or automated extraction tools without our written permission,
reverse engineer, decompile, or attempt to derive source code (except to the extent permitted by law),
upload malware or conduct any activity that disrupts the Platform, or
post or transmit unlawful, abusive, defamatory, obscene, hateful, or illegally discriminatory content.
We may investigate suspected violations and may cooperate with law enforcement or regulators where lawful.
9. Applications, visibility settings, and sharing
Your profile and applications may be shared with employers or recruiters in accordance with your Platform settings and your actions (for example, applying to a role).
If you apply for a role, you authorise us to provide the relevant application and profile information to the relevant employer or recruiter. Employers or recruiters may store your information in their own systems or in recruitment software they use. Their handling of your information outside the Platform is governed by their own policies and obligations.
If the Platform includes profile visibility settings or profile sharing features, you are responsible for selecting the settings that suit your preferences and understanding how those settings affect who can view your information.
10. Verification, assessment, and workforce assurance features
The Platform may include features designed to support integrity, verification, assessment, and workforce assurance processes, including document and credential checks and other screening or assessment steps.
You acknowledge that:
we may request evidence to support claims you make about identity, experience, credentials, licences, and eligibility,
some verification may be performed using third-party providers, and
verification processes reduce risk but do not guarantee outcomes.
If we reasonably believe information is false, misleading, or non-genuine, we may restrict your account, decline to process an application, or take other action consistent with these Terms and applicable law.
11. Automated tools and AI-supported features
The Platform may use automated tools, including artificial intelligence and machine learning, to support Platform operations and features, such as:
parsing resumes or application inputs,
generating matching or ranking signals,
recommending application questions or workflow actions,
detecting suspicious or abusive activity.
These tools are used to support Platform features and integrity controls. They do not guarantee outcomes. Where appropriate, human review may occur within recruitment workflows. Employers or recruiters remain responsible for their hiring decisions.
12. User content and licences
“User Content” means information, materials, and content you submit or upload to the Platform (including your profile, resume, answers, messages, and attachments).
You retain ownership of your User Content, subject to the licences you grant under these Terms and your privacy settings.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for formatting and Platform display), transmit, and display your User Content to operate the Platform, provide services, enable applications, and deliver Platform features, subject to:
your settings,
our Workforce Privacy Policy, and
applicable law.
We may remove or restrict User Content if we reasonably believe it breaches these Terms, creates risk, or is unlawful.
13. Advertising, sponsorship, and marketplace features
Parts of the Platform may include advertising, sponsorship, and promotional materials. Advertisers are responsible for ensuring advertising content complies with applicable laws and codes.
We may refuse, remove, or restrict advertisements or sponsored content in our discretion.
Where targeted advertising is enabled, it is managed through our cookie and tracking controls and explained in our Workforce Privacy Policy.
Advertising does not guarantee a particular recruitment outcome and does not constitute endorsement of a third party, job opportunity, or service.
14. Privacy, security, and breach handling
14.1 Privacy
Our collection, use, disclosure, retention, and cross-border handling of personal information is governed by our Workforce Privacy Policy, together with any channel-specific notices provided at the point of collection.
These Terms do not limit your rights under applicable privacy or consumer protection laws.
14.2 Security
We operate security controls consistent with our Information Security Policy. You must also take reasonable steps to protect your account and devices.
14.3 Data breaches
We manage suspected or actual data breaches under our Data Breach Response Procedure, including assessment, containment, remediation, and notification where required by law.
14.4 Suppliers
Where suppliers or service providers process information on our behalf, we apply controls described in our Supplier Information Security & Privacy Assurance Statement.
15. Third-party services and links
The Platform may integrate with or link to third-party services (including identity providers, employer systems, recruitment software, and external websites). We do not control those third parties and are not responsible for their content, security, or practices.
If you provide information directly to a third party, their terms and policies apply.
16. Availability and changes to the Platform
We aim to provide a reliable Platform, but we do not guarantee uninterrupted, fault-free, or error-free operation.
We may modify, suspend, or discontinue any part of the Platform at any time, including features, content, or availability, for maintenance, upgrades, security, legal compliance, or operational reasons.
You are responsible for maintaining your own copies of information you submit to the Platform.
17. Suspension, restriction, and termination
We may suspend, restrict, or terminate your account or access immediately if we reasonably believe you:
breached these Terms,
engaged in unlawful or harmful conduct,
created a security or integrity risk,
attempted to misuse Platform systems, or
provided false or misleading information.
Where appropriate, we may provide notice and an opportunity to remedy a breach. We are not required to provide a remedy period where immediate action is necessary for security, integrity, legal, or risk reasons.
You may close your account at any time using Platform settings or by contacting us.
Account closure does not guarantee immediate deletion of information held by employers or recruiters outside our Platform, and does not override retention requirements described in our Workforce Privacy Policy.
18. Disclaimers
To the maximum extent permitted by law:
the Platform is provided on an “as is” and “as available” basis,
we do not warrant that the Platform will meet your requirements,
we do not warrant that the Platform will be uninterrupted, timely, secure, or error-free, and
we do not warrant that content, listings, messages, or User Content are accurate, complete, reliable, lawful, or available.
We do not endorse or recommend any employer, recruiter, job opportunity, candidate, or User Content. You assume all risks associated with interactions with other users and third parties, including risks arising from misrepresentation.
19. Limitation of liability
To the maximum extent permitted by law:
we are not liable for indirect or consequential loss, loss of profits, loss of business, loss of opportunity, or loss of data arising from your use of the Platform,
our total aggregate liability to you for claims arising out of or in connection with the Platform is limited to AUD 100, unless a higher amount is required by non-excludable law.
Where liability cannot be excluded under applicable law, our liability is limited (at our option) to:
resupplying the services, or
paying the cost of having the services resupplied,
to the extent permitted by law.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
While Global Talent Pathway implements information security controls consistent with its Information Security Policy, no system is completely secure. You acknowledge and agree that Global Talent Pathway does not guarantee that unauthorised access, data loss, or security incidents will never occur, and disclaims liability for such events to the maximum extent permitted by law, except where caused by Global Talent Pathway’s failure to take reasonable steps required by applicable law.
20. Indemnity
To the maximum extent permitted by law, you agree to indemnify the GTP Group and its officers, directors, employees, and agents from loss or damage arising from:
your breach of these Terms,
your User Content, or
your unlawful use of the Platform,
except to the extent we contributed to the loss or damage.
21. Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts of Victoria, Australia, subject to any mandatory rights you may have in your local jurisdiction that cannot be excluded.
If you access the Platform from outside Australia, you are responsible for complying with local laws that apply to your use of the Platform.
22. Assignment and transfer
We may assign, novate, or transfer these Terms (or any rights or obligations under them) to another member of the GTP Group or a successor entity. If we do so, we will take reasonable steps to notify you and we will not materially reduce the protections described in our published privacy and security documents without notice.
You may not transfer your rights or obligations under these Terms without our written consent.
23. Translations
These Terms may be translated. If there is any inconsistency between the English version and a translated version, the English version prevails to the extent permitted by law.
24. Miscellaneous
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
If we do not enforce a provision, we may enforce it later.
Headings are for convenience only and do not affect interpretation.
25. Definitions
Advertiser means a person or entity that posts job advertisements or other promotional material on the Platform.
Candidate means an individual using the Platform to create a profile, seek opportunities, or apply for roles for themselves.
Employer / Recruiter means a person or entity seeking candidates for employment or engagement and using the Platform for recruitment workflows.
Platform has the meaning given in section 1.
User Content has the meaning given in section 12.
GTP Group has the meaning given in section 2.
